Ward Photography LLC – Real Estate Photography Services
By booking photography or related services with Ward Photography LLC, the client agrees to the following Terms & Conditions.
The property should be photo-ready at the scheduled appointment time. This includes cleaning, decluttering, securing pets, opening blinds or curtains as desired, turning on appropriate lighting, and completing any staging or property preparation before the photographer arrives.
Ward Photography LLC is not responsible for cleaning, staging, moving furniture, personal belongings, vehicles, trash cans, pet items, or other objects unless an editing or decluttering service has been specifically purchased.
The photographer may make minor adjustments when practical but is not responsible for preparing the property for photography.
The client is responsible for ensuring that Ward Photography LLC has permission and access to the property at the scheduled time.
Delays caused by unavailable keys, incorrect lockbox information, occupants, contractors, pets, or other access issues may result in additional fees or the appointment being rescheduled.
By ordering services, the client represents that they have authority to grant Ward Photography LLC access to and permission to photograph the property.
Please provide as much notice as possible when canceling or rescheduling an appointment. If the photographer arrives at the property and is unable to complete the scheduled work because the property is inaccessible, not ready, unsafe, or otherwise unable to be photographed, a trip or rescheduling fee may apply.
Exterior photography may be affected by rain, snow, heavy fog, high winds, or other weather conditions.
Ward Photography LLC will make reasonable efforts to produce professional images under existing conditions. When weather conditions make photography impractical or unsafe, the appointment may be rescheduled.
Cloudy skies or other normal weather conditions do not automatically qualify a session for a complimentary reshoot.
Ward Photography LLC retains creative discretion regarding composition, camera position, lighting, image selection, editing, and overall photographic style.
Standard editing may include adjustments to exposure, color, contrast, perspective, window views, and other normal real estate photography corrections.
Extensive object removal, virtual staging, decluttering, lawn replacement, sky replacement, twilight conversion, or other advanced alterations may require an additional editing fee unless included in the purchased service.
Editing requests that materially misrepresent the permanent characteristics or condition of a property may be declined.
Images will normally be delivered within the turnaround time stated for the service purchased. Turnaround times are estimates and may vary due to workload, property size, service requirements, weather, technical issues, or other circumstances.
Rush delivery may be available for an additional fee.
Clients should review delivered media promptly and notify Ward Photography LLC of any concerns or requested corrections.
Reasonable corrections relating to photography or editing errors may be completed at no additional charge.
Requests involving changes outside the original scope of work, extensive retouching, removal of items present at the property, or changes requested after delivery may be subject to additional fees.
Complimentary reshoots are provided only when Ward Photography LLC determines that a significant technical or photographic error occurred.
Reshoots requested because of property condition, staging, landscaping, construction, weather preferences, homeowner requests, items left in the property, or changes made to the property after the original appointment may be billed as a new visit or reshoot.
Unless otherwise agreed in writing, all photographs, videos, floor plans, and other media created by Ward Photography LLC remain the copyrighted property of Ward Photography LLC.
Upon full payment, the client receives a limited, non-exclusive license to use the delivered media for marketing the property associated with the original photography assignment. This may include MLS listings, real estate websites, social media, digital advertising, brochures, flyers, and other customary property-marketing uses.
Copyright ownership is not transferred to the client.
Media may not be sold, transferred, sublicensed, or provided for commercial use by third parties—including builders, architects, interior designers, contractors, property managers, publications, or other businesses—without permission from Ward Photography LLC.
Additional or extended licensing may be available upon request.
Payment is due according to the terms shown on the invoice.
Ward Photography LLC may withhold final media delivery or usage rights until payment has been received in full.
Floor plans and measurements provided by Ward Photography LLC are intended for marketing and informational purposes only.
Measurements and calculated square footage are approximate and should not be relied upon for appraisals, construction, architectural, engineering, legal, or other purposes requiring certified measurements.
Clients and prospective buyers should independently verify measurements and square footage when accuracy is material to their decision.
Virtually staged or digitally altered images are intended for marketing and visualization purposes.
When appropriate, clients are responsible for complying with applicable MLS rules and disclosure requirements concerning virtual staging or digitally modified photographs.
Ward Photography LLC is not responsible for a client's failure to properly identify or disclose virtually staged or materially altered images when required.
Drone photography is subject to weather conditions, airspace restrictions, FAA regulations, property conditions, and the photographer's determination that the flight can be conducted safely and legally.
Aerial photography may be modified, postponed, or canceled when conditions do not permit safe or lawful operation.
Ward Photography LLC reserves the right to decline or discontinue services when the photographer determines that a property, structure, animal, person, weather condition, or other circumstance presents an unreasonable safety risk.
In the event of equipment failure, file corruption, accidental loss, or another circumstance that prevents delivery of the purchased media, Ward Photography LLC's liability will be limited to the amount paid for the affected service.
Ward Photography LLC is not responsible for indirect, incidental, or consequential losses resulting from the use or inability to use delivered media.
Ward Photography LLC may use photographs and other media created during an assignment for portfolio, website, social media, competition, educational, or promotional purposes unless otherwise agreed in writing.
Booking, purchasing, or using services provided by Ward Photography LLC constitutes acceptance of these Terms & Conditions.
Ward Photography LLC reserves the right to update these Terms & Conditions. The terms in effect at the time a service is booked will apply to that assignment.
